Re: Global Learning Group Inc.
As an update, service of the Statement of Claim continues to be a problem. Some of Defendants have been avoiding service and avoid having to answer for what we believe will be found as wrongdoing by them.
On July 5th, 2016, we applied to a judge of the Court of Queen's Bench for an order of substituted service and an extension of time to serve the statement of claim. Madam Justice McMurtry extended the time to serve the claims until February 2017, and while we did receive some assistance, we did not receive all the relief we sought. In relation to some of the requests for substituted service, the Court held that further efforts could be made to effect service and we pursued those further efforts. Then on July 25th, 2016, we filed another application for substituted service and we await the decision of the Court on that application.
The Defendants who remain to be served, directly or substitutionally are:
Global Learning Group Inc. Jack Keslassy
James Penturn Michael Morris
Phoenix Learning Corporation Inc. Estate of Michael Ozerkevich EMC Partners Inc.
Service has been attempted several times on Wendy and Robert Lewis, including Global Learning Group Inc. Access to the Lewis' front door is impossible as the property is gated, with an intercom system monitoring entry in and out of the property. These circumstances alone make it impractical to effect service personally on those three defendants.
James Penturn is in the process of being served by the Central Authority in England pursuant to the Hague Convention. There is no way to determine how long the Central Authority will take.
Jack Keslassy is Florida and service upon him at that location is currently underway.
The last known address of Michael Morris and Phoenix Learning Corporation is in the Bahamas but his exact location is currently unknown.
We may strike the Estate of Michael Ozerkevich and EMC Partners Inc. as defendants. EMC Partners is no longer active and neither party has any assets. Michael Ozerkevich died intestate without an estate.
It is difficult not to be cynical in circumstances where these people appear to be evading service and living well on the money of GLGI donors.
