Service is difficult. Some of those who we believe to be wrongdoers are avoiding service - avoiding being called before the Court to answer. A considerable amount of money and effort has gone into effecting service.
On July 4 we applied for what is known as substitutional service. This is an application for a Court order by which we ask that the documents be served on people other than the people avoiding service and the Court will deem that to be good service. These documents were completed on July 3 and the final affidavit in support of this application was sworn on July 4.
Almost all of the Defendants have been served and they have gone to lawyers. Those lawyers are in contact with Merchant Law. But we have to serve all the Defendants before the Court will allow us to move forward. That is why we applied for an order for substitutional service and we are now waiting to see what the Court decides regarding that application.
